Regulations for Safely conducting Burning in the city of Payette:

Do I need a burn Permit?

All burning in the City of Payette will require a permit.

RECREATIONAL FIRES, such as a backyard fire pit, portable outdoor fireplace or chimenea require a permit and can be good for up to 90 days.

OPEN BURNS for natural yard debris require a permit and is good up to five days. Burning hours are from dawn to dusk. Any open burning is prohibited when temperature exceeds 90 degrees, or wind speed is over 10 mph, regardless if a permit has been issued or not.

BONFIRES for special events must apply for a permit one week prior to the event. The permit is only good for the day of the event.

Where can I have a fire?

RECREATIONAL FIRES shall not be conducted within 15 feet of a structure or any combustible material. Conditions that could cause a recreational fire to spread within 15 feet of a structure shall be eliminated prior to ignition (see PMC 8.28.050 A.1.).

BONFIRES AND OPEN BURNS shall be at least 50 feet from any structure or combustible material. Conditions which could cause a bonfire or open burn to spread within 50 feet of a structure shall be eliminated prior to ignition ( see IFC 307.4).

Can I leave a fire?

ALL OPEN BURNS, BONFIRES AND RECREATIONAL FIRES, to include portable outdoor fireplaces, shall be constantly attended by an adult at least 18 years of age or older, until the fire is completely extinguished.

As per 2009 IFC, a minimum of one portable fire extinguisher with a minimum 4-A rating or other approved on-site fire extinguisher, such as dirt, sand, water barrel, garden hose or water truck, shall be available for immediate utilization ( See IFC 307.5).

Can I be ordered to extinguish my fire?

It is very important to note that any fire, regardless of permit, that is offensive or objectionable to the public due to smoke emissions, or when atmospheric conditions, or local circumstances make the fire hazardous are prohibited (see IFC 307.1.1).

The fire code official is authorized to order the extinguishment of any fire, even by a permit holder that creates or adds to a hazardous or objectionable situation, such as smoke emissions (see IFC 307.3).

Can I use a burn barrel for my trash?

NO!! Burn barrels are strictly prohibited for burning trash in the city of Payette!

It is your responsibility to confirm that a burn ban is not in effect the day of your planned burn.
